Terms of Use

1. Acceptance

By accessing or using Qsendyx you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. The Service

Qsendyx lets you send SMS and email (transactional, OTP and campaigns) through a web portal, an API with tokens, and webhooks. Qsendyx is a software and orchestration layer over third-party carriers and email providers; we are not a telecom operator and do not own numbering or IP reputation. Features, plans and limits may change as the product evolves.

3. Accounts and organizations

You are responsible for the accuracy of your account information and for keeping your credentials and API tokens confidential. Activity under your account and within your organization (tenant) is your responsibility. Data is isolated per organization.

4. Acceptable use

You agree not to use the Service to:

• Send unsolicited bulk messages (spam), or message recipients who have not given the consent required by law.
• Send phishing, malware, deceptive, fraudulent or unlawful content, or impersonate any person or organization.
• Message recipients who have opted out, or ignore STOP and unsubscribe requests.
• Inflate traffic artificially, including SMS pumping (AIT), or abuse OTP and verification flows.
• Attempt to break tenant isolation, access other customers’ data, or probe the Service’s security without authorization.
• Interfere with or disrupt the integrity or performance of the Service, or bypass its quotas, rate limits or suppression lists.

5. Consent, compliance and opt-out

You are the controller of your contact lists and are responsible for having a lawful basis (including consent where required) to message each recipient. You must honor opt-out requests: STOP (and equivalents) for SMS and a working unsubscribe link for marketing email. Qsendyx enforces suppression and keeps an opt-out list, but that does not replace your own compliance with anti-spam and data-protection law, including the LGPD, and with carrier and sender-registration rules that apply to your traffic.

6. Deliverability and sender reputation

You may only send from verified senders and authenticated domains. Because reputation on shared infrastructure is a common good, we may throttle, queue, require verification for, or suspend traffic that generates excessive bounces, complaints or abuse reports, to protect the platform and other customers. We do not guarantee inbox placement or delivery, which depend on carriers, email providers and recipient systems outside our control.

7. Your content

You retain all rights to the messages, templates and contact data you upload or send. You grant Quathos LLC the limited rights needed to host, process and transmit them solely to provide the Service. We do not claim ownership of your content.

8. Intellectual property

Qsendyx, including its software, design and trademarks, is owned by Quathos LLC. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they transfer no ownership in the platform.

9. Plans, fees and credits

Paid plans, prices and limits shown in the Service may be placeholders during development and are subject to change. Where fees apply, they are billed through our payment provider under the plan you select. Message credits are consumed as you send, per your usage ledger; consumed sends are non-refundable except where the law requires otherwise. SMS cost depends on message length and encoding. Messages that require UCS-2 (for example, accented characters) may cost more than plain GSM-7.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We are not a telecom carrier and do not warrant that any given message will be delivered, or that the Service will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law, Quathos LLC will not be liable for indirect, incidental, special or consequential damages, or for loss of profits or data, arising from your use of the Service.

12. Suspension and termination

We may suspend or terminate access (including by an emergency kill switch on sending) where it violates these Terms or poses a security, deliverability or legal risk. You may stop using the Service at any time; certain provisions survive termination.

13. Governing law

These Terms are governed by the laws applicable to Quathos LLC in the State of Texas, United States, without prejudice to mandatory consumer or data-protection rules of your place of residence.

14. Changes

We may update these Terms. Continued use after changes take effect constitutes acceptance of the updated Terms.
